The Aquatic PT – Terms & Conditions App based service agreement

At The Aquatic PT we care about your health, safety, and experience. These terms are here to make sure we look after you while keeping things simple and transparent.

Acceptance of Terms

By purchasing a membership, you agree to be bound by these Terms and Conditions.

1. Your Health & Safety

• Before starting, you’ll complete a health questionnaire so we can support you safely.

• Please let us know of any changes to your health. If you’re unsure whether exercise is safe for you, check with your doctor first.

• If you have any contagious illness, open wounds, or infections, please wait until you’re fully recovered before attending a session.

• ​​By enrolling in this in person, personal training program, you acknowledge and agree to the following:

• Risk of Injury: You understand that participating in any physical activity, including online workouts, carries inherent risks of injury, including but not limited to, strains, sprains, fractures, and other physical harm.

• Assumption of Risk: You voluntarily assume all risks associated with your participation in this program, including any risks that may arise from following the workout plans or nutritional advice provided.

• Medical Clearance: You represent that you are in good physical health and have consulted with a healthcare professional before starting this program.

• Equipment Use: You are responsible for ensuring that you use any equipment safely and appropriately.   

• I understand using my phone or other electronic equipment beside the pool is at my own risk.

• We strongly recommend against exercising alone, especially in water. In case of an emergency, it’s crucial to have others around who can assist or call for help.

2. Duty of Care & Liability

• By training with us, you accept that exercise carries some risk and agree that The Aquatic PT is not liable for injury or damage to personal property except where required by New Zealand law.

3. Membership & Payments

 

Payment

• You agree to pay the membership fee as stated on your program.

• Payments will be processed automatically on a recurring basis.

 

Cancellation Policy

• To cancel your membership, you must cancel it directly through your membership portal. Once cancelled, your membership will be terminated at the end of your current billing cycle.

• To cancel your membership, you must log into your account on the web version of the app www.theaquaticpt.beta.trainerize.com and navigate to My Purchases. 

• I understand and respect that The Aquatic PT has the right to refuse, cancel, or hold any future or ongoing services if they think a medical clearance is necessary and/or required. 

• I understand and acknowledge that The Aquatic PT reserves the right to refuse, suspend, or terminate any current or future services at its sole discretion.

 

Refund Policy

• No Refunds for Digital Products: Due to the nature of digital products, no refunds will be issued for membership fees once the membership is activated.

• Exceptions: In exceptional circumstances, such as unforeseen circumstances or technical difficulties that significantly impact your ability to access the program, a refund may be considered on a case-by-case basis.

 

4. Digital Content

•  Progress Photos may be published on any digital platform by The Aquatic PT with the client's written consent.

5. Intellectual Property and Program Resources Policy

•  All content provided within this membership, including workout plans, nutrition advice, and other materials, is the intellectual property of The Aquatic PT. 

• Any sharing, copying, selling or otherwise of our Intellectual property without our consent with any person/s that is not directly involved with The Aquatic PT will be considered as theft of property and will be dealt with as a criminal act or offence.

•  You agree not to share, distribute, or reproduce any of this content without explicit permission.

6. The Client agrees not to make or publish any statements, whether oral, written, or electronic, that may be considered disparaging, defamatory, or damaging to the Trainer, the services provided, or the training facility.

 

7. Modifications to Terms

●      We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website.
